Slightly confused on what you mean. Do you mean "moderate" as in the job a moderator performs or "moderate" to move away from an extreme. I'll tackle both.

Definition 1: You cannot reliably moderate (enforce) a zero-tolerance policy in this sort of case. Zero tolerance on other things like porn on a forum can be, but not in a case like this where the rule is in almost perfect opposition to a stated goal.

Definition 2: A simple way to moderate (make less extreme) a zero-tolerance policy is to focus on what you are actually opposing. In this case by focusing on distribution of game files, which is what is really the issue.

Umm, I think we're erroneously merging two separate aspects of the rules into one here. It may be that Nalates comment, above, was meant to segregate them, but you can easily read it two ways (well, I could anyway).

The reference to "Zero Tolerance" is specifically in Policy III which covers trolling, flaming, abuse. etc., and is not greatly different to the previous Rule 6.

The Hacking/Cracking stuff is in Policy I and is a different matter.
